PAID SUBSCRIPTION SERVICE SUBSCRIBER AGREEMENT
Summary of Terms and Conditions of Subscription

• The text and other content contained in the Science Online Website ("Website") is protected by United States Copyright Law, and must be respected, acknowledged, and not infringed.
• The contents of this Website may only be used by a Subscriber, and only for his/her noncommercial personal use. The contents may not be modified in any way. Except as provided for in special AAAS site licenses, unauthorized uses, including sharing a password or letting a non-Subscriber use the services may result in cancellation of Subscription privileges, and/or civil and criminal penalty under appropriate law.
• AAAS®, Science®, Science Online, ScienceNOW, Science Signaling, and SAGE KE are the trademarks of the American Association for the Advancement of Science, and may not be used by Subscribers in a way which is likely to cause confusion or deceive as to the connection of AAAS and the Subscriber's goods or services, including any other website.
• Subscribers may not use AAAS trademarks or the text or graphic materials contained in this Website to endorse, sponsor or show affiliation of the Subscriber by or with AAAS.
• AAAS may modify the Terms and Conditions for this Paid Subscription Service at any time; AAAS may change any aspect of this Website or the Paid Subscription Service at any time, including restricting a Subscriber's access to the Paid Subscription Service, subject to a pro rata refund of any unused subscription fee.
• The Subscriber represents that nothing uploaded, distributed or published on the Science Online Website through the Subscriber's account will violate any copyright, trademark or similar law, or will be libelous, defamatory, obscene, pornographic, abusive, or otherwise in violation of any law.
• AAAS is not obligated to post all comments from users. AAAS also reserves the right to remove, or simply not to post any comment it deems to be, or believes others may deem to be, offensive, libelous, slanderous or otherwise illegal. A notice of these terms of usage will be posted at each discussion group. Subscribers shall remain solely responsible for the content of their messages. Forums, "chat rooms," or e-mail/Web discussion groups on this Website may not be used to solicit funds, advertise or sell goods or services.

By clicking on the button marked "Submit" on the registration page you warrant that you have the authority to agree to, and you agree that you have read, understood and will be bound by, these Terms and Conditions of Subscription, which, along with your use of the service, constitutes your agreement with the terms and conditions of this Subscription Agreement as a Subscriber.

Terms and Conditions of Subscription

1. Copyright Notice
   

   The materials contained on the Science Online Website ("Website"), are protected under copyright and other laws of the United States, and, under international conventions, similar laws abroad.

   Copyright in the materials contained on this Website, including, but not limited to, the textual material, artwork, photographs, computer software, audio and visual elements, is owned or controlled separately (and as a collective work exclusively) by the American Association for the Advancement of Science ("AAAS"). In addition, copyright in the selection, arrangement and coordination of materials in this Website is owned exclusively by AAAS.

2. Limitations on Use by (and to) a Subscriber
   

   The contents of this Website may only be accessed, viewed or otherwise used by a registered Subscriber. Subscribers are only permitted to view and/or browse the contents of this Website, and/or make only limited copies of portions of this work as fall within the fair use provisions of the Copyright Act, provided all such uses are for noncommercial personal purposes, and further provided that the Subscriber maintains all copyright and any other notices, on all copies. Subscribers are not, however, permitted to store in electronic or any other form, any significant portion of this Website. The contents of this Website may not be further reproduced, distributed, transmitted, modified, adapted, performed, displayed (including adaptations/displays such as by "framing"), published or sold in whole or in part, without the prior written permission from AAAS.

   Any use which is commercial and/or non-personal is strictly prohibited, and may subject the Subscriber making such uses to immediate revocation of access to this Paid Subscription Service, as well as any other applicable civil or criminal penalties. Similarly, sharing a Subscriber password with a non-Subscriber or otherwise making this Paid Subscription Service available to third parties is strictly prohibited, and may subject the Subscriber participating in such activities to immediate revocation of access to the Paid Subscription Services; and, the Subscriber and any third party, to any other applicable civil or criminal penalties under copyright or other laws.

   In the case of an authorized site license, a Subscriber shall cause any employee, agent or other third party which the Subscriber allows to use the Paid Subscription Service materials to abide by all of the terms and conditions of this Agreement. In all other cases, only the Subscriber is permitted to access the Paid Subscription Service materials.

3. Trademark Notice
   

   AAAS®, Science®, Science Online, ScienceNOW, Science Signaling and SAGE KE are trademarks of the American Association for the Advancement of Science. Any use of the marks in connection with the sale, offering for sale, distribution or advertising of any goods and services, including any other website, or in connection with labels, signs, prints, packages, wrappers, receptacles or advertisements used for the sale, offering for sale, distribution or advertising of any goods and services, including any other website, which is likely to cause confusion, to cause mistake or to deceive, is strictly prohibited.

4. No Endorsements
   

   Any use of "AAAS" or, of any text or other material, in whole or in part, contained in this Website in any manner to express or imply endorsement, sponsorship, affiliation, connection, or association of the Subscriber by or with AAAS, or to cause confusion, to cause mistake, or to deceive as to the origin, sponsorship or approval of the Subscriber's goods, services or commercial activities with AAAS, is strictly prohibited.

5. Modification of Terms and Conditions
   

   AAAS reserves the right at its discretion to change, modify, add or remove the Terms and Conditions for this Paid Subscription Service at any time. Such changes shall be posted on the Science Online Website, and all Subscribers shall be notified of such changes. A Subscriber's continued use of the Science Online Paid Subscription Service materials following the posting and such notification of any change to these Terms and Conditions will constitute acceptance by the Subscriber of the Terms and Conditions as modified.

6. Modification of Website or Subscription Service
   

   AAAS reserves the right to change, modify, suspend or discontinue any or all parts of the Science Online Website or the Paid Subscription Services at any time. AAAS reserves the right to restrict a Subscriber's access to parts or all of the Subscription Service without notice or liability. Upon any such suspension or cancellation of service, any Subscriber wishing a refund of a pro rata portion of his/her Subscription fee shall contact membership2@aaas.org.

7. Representations and Warranties
   

   The Subscriber represents, warrants, and covenants that nothing uploaded, distributed or published on the Science Online Website or the Science Online Paid Subscription Service through the Subscriber's account will be libelous, defamatory, obscene, pornographic, abusive or invade the rights of privacy or other personal or property rights or infringe the copyright or trademark of any person or entity. The Subscriber shall indemnify, defend and hold AAAS harmless from any damages, expenses and costs (including reasonable attorneys' fees) arising out of any breach or alleged breach of these Terms and Conditions, representations and/or warranties herein, by the Subscriber or any third party to whom Subscriber shares her/his password or otherwise makes available this Subscription Service. The Subscriber shall cooperate in the defense of any claim brought against AAAS.

8. Forums, "Chat Rooms" and e-mail/Web Discussion Groups
   

   As part of the Subscription, Subscriber will have access to forums, "chat rooms," and e-mail/Web discussion groups to which the Subscriber will be able to send messages and other content. AAAS is not obligated to post all comments from Subscribers. AAAS also has the right to remove, or simply not to post any comment it deems to be, or believes others may deem to be, offensive, libelous, slanderous or otherwise illegal. A notice of these terms of usage will be posted at each discussion group. Subscribers shall remain solely responsible for the content of their messages. Subscriber warrants that any and all moral rights in any uploaded materials have been waived.

   AAAS shall not be responsible for communications or activities occurring outside the context of a forum, "chat room," or e-mail/Web discussion group even if such communication or activity commences or continues in the context of a forum, "chat room" or e-mail/Web discussion group. The Subscriber further represents and warrants to AAAS that forums, "chat rooms," or e-mail/Web discussion groups on the AAAS Website will not be used for the solicitation of funds, advertising or solicitation for goods or services. The Subscriber shall indemnify and hold AAAS harmless from any damages, expenses and costs (including reasonable attorneys' fees) arising out of any breach or alleged breach of the Subscriber's representations and warranties in this section.

9. Registration
   

   To register, Subscriber must assent to these Terms and Conditions by clicking on the "Submit" button on the registration page, and must provide AAAS with accurate and complete registration information. Failure to provide accurate and complete information, and failure to timely update the information requested on the registration form may result in delays in establishing Subscriber access to the Subscription Service, AAAS' denial of an application or the revocation of Subscriber access to the Subscription Service.

10. Security
    

    As part of the registration process, an applicant for a Subscription will be asked to select a password and Subscriber name. Knowing use of the Subscriber name of another or the selection of a name which AAAS deems offensive may result in termination of access to the Subscription Service.
